Guns, Germs, and Steel was assigned reading in a geography class I took two semesters ago. There was some interesting stuff in there, but I ended up selling it back at the end of the semester. (Although for the price they gave me I probably should have just kept it. :P )

I wouldn't know; law isn't my area of expertise. Apparently our legislature disagrees since the topic has been debated so many times in the past. That’s the best answer I can give you.

Heh. Apparently the California State Assembly doesn't know that. The site in my last post has a couple audio clips(very short ones) of them discussing it.
